General Policy

The following General Policy applies to all Participants, spectators and visitors attending ESF 2019.  This General Policy applies in addition to the rules applying to a specific sporting event and any other relevant ESF 2019 policies.

Definitions

In this General Policy, the following definitions apply:

Campus” means the Nottingham University campus and buildings within the campus including but not limited to the David Ross Sports Village, East Midlands Conference Centre, Nottingham Tennis Centre, Orchard Hotel, Jubilee Conference Centre Hotel, the Halls of Residences, The Nottinghamshire Golf & Country Club, Bar Lane Community Sports, Loughborough University Tennis Centre and any other buildings and grounds that ESF 2019 will be using.

Drugs” shall be construed in the context of the Misuse of Drugs Act 1971 and includes without limitation:

·        inhalants

·        any class of illegal drugs

·        substances designed to look like illegal drugs

·        substances reported to be illegal drugs and

·        drug paraphernalia (i.e. any item, equipment, product or material that is modified for making, using or concealing illegal drugs).

ESF 2019” means the European Sports Festival taking place between Friday 19th April 2019 and Monday 22nd April 2019 (inclusive) including organised transport to and from the Campus and any build-up and break-down days required for the event.

Offensive Weapons” means:

·        any article made or adapted for causing injury, or intended to cause injury or

·        any object carried for the intention of causing harm or injury to another,

and includes without limitation any authentic or fake bladed or sharply pointed object, such as a screwdriver, broken bottles, knives, pen-knives or guns.

Organisers” means the team responsible for the organisation and delivery of ESF 2019, including any member of the Aga Khan Youth & Sports Board (AKYSB) and any members of the executive team (including chairs and vice chairs).

Participant” means any person competing in one or more individual or team sport during ESF 2019.

Spectator” or “visitor“means any person attending ESF 2019 who is not a Participant.

General Rules

1.      ESF 2019 is an event for members of the Ismaili community and their immediate non-Ismaili family.

2.      Any Participant, spectator or visitor who is under the age of 16 must be accompanied by a responsible adult at all times.

3.      The Organisers reserve the right to refuse entry to any person to specific events or activities or to ESF 2019 in its entirety for any reason at its discretion.

4.      To ensure the safety and security of everyone attending ESF 2019, Participants, spectators and visitors may be asked by the Organisers or any member of the security team to produce identification at any time.

5.      The Organisers reserve the right to amend or change any rules relating to any sporting event or any of the policies applying to ESF 2019 at any time.  The Organisers will take all reasonable steps to inform Participants, spectators and visitors of any such amendments or changes.

Zero Tolerance policy

ESF 2019 operates a Zero Tolerance policy.  This policy covers the following:

1.      Violent, aggressive or disorderly behaviour by any Participant, whether physical or verbal, directed to his or her opponent(s), the referees/officials, the Organisers, spectators or visitors.  In such cases, the Participant will be asked to leave the immediate area.  Such behaviour will result in the automatic disqualification of the Participant from the relevant sports tournament and may also result in the potential expulsion of his/her team from the relevant sports tournament.
In certain circumstances, violent, aggressive or disorderly behaviour may result in the Participant and/or his/her team being expelled from ESF 2019 and/or banned from participating in, or attending, future AKYSB events. This decision is at the discretion of the Organisers.

2.      Spectators inciting or participating in violent, aggressive or disorderly behaviour will be required to leave the area/venue immediately.  Such behaviour may result in the spectator being expelled from ESF 2019 and/or banned from participating in, or attending, future AKYSB events.  This decision is at the discretion of the Organisers.

3.      Drugs, alcohol and/or Offensive Weapons. The use, possession, supply or distribution of Drugs or Offensive Weapons is a criminal offence. If charged and convicted a person may be liable to serve a term of imprisonment.

4.      ESF 2019 operates a Zero Tolerance policy in relation to Drugs, alcohol and Offensive Weapons.  If any Participant, spectator or visitor is found to have breached the Zero Tolerance policy (including if he/she is present, but is not actively involved or participating in, the relevant behaviour), the Organisers may take such action as they consider appropriate, including alerting the appropriate authorities and removal of the Participant, spectator or visitor from ESF 2019. The Organisers may also take legal action.  The Participant, spectator or visitor may also be prevented from participating in, or attending, any future AKYSB events.

5.      Smoking: smoking at ESF 2019 is strictly prohibited. The Organisers may take such action as they consider appropriate in these circumstances.

External security will be called upon if necessary in the above situations.

Disclaimer

The Organisers, the Ismaili Council for the United Kingdom and/or CFR (UK) shall not be liable for any costs or claims whatsoever arising from injury to any person or damage or loss to property arising as a result of attendance at, or participation in, ESF 2019, whether or not such injury or damage or loss is caused either directly or indirectly, or wholly or in part by the Organisers, the Ismaili Council for the United Kingdom and/or CFR (UK), unless such injury or damage or loss to property shall be proved conclusively to have been caused by the negligence of the Organisers, the Ismaili Council for the United Kingdom and/or CFR (UK).

Privacy Policy

We are committed to protecting and respecting your privacy.

This policy (together with our “Terms of use“) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully.

Please note that the site may, from time to time, contain links to and from other websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

When you provide information to us, the data will be held by the Ismaili Council for the United Kingdom and, if relevant, CFR (UK), as data controller(s) under the Data Protection Act 1998.

Any personal data that you provide to us, or that we collect from you, will be deemed to be "Personal Data" for the purposes of the privacy policy of the.Ismaili website and shall be treated and processed accordingly (this policy can be found Here)  

In addition such Personal Data provided in connection with ESF 2019 may be used: 

·        to contact you electronically (by e-mail and/or by SMS) when necessary in connection with your registration or attendance at ESF 2019 and

·        for administrative and organisational purposes, including the “Player Finder” service and to allocate your volunteer duties and

·        to contact you electronically (by email, SMS or via the IIUK app) for marketing purposes, if you given us permission to do so.

We may also contact you by e-mail to ask you to complete feedback and evaluation surveys on the site/ESF 2019 and on AKYSB events more generally, although you do not have to respond to them. We may also use your data to provide you with information about future institutional events, programmes and services which may be of interest to you and we may contact you about these by e-mail or SMS.

We may also take photographs and videos of you during ESF 2019 and may use these photographs and/or videos on the site or in any community-based publications (including on The.Ismaili website) and in future promotional material. Please notify us at [email protected] if you do not wish your image to be included in such materials or displays and we will use all reasonable endeavours to accommodate such requests. Please note that photographs and videos of Participants, spectators or visitors under the age of 18 will not be displayed on The.Ismaili website without your (or your parent’s) permission.

Social Media Policy

ESF 2019 will have a social media presence before, during and after the festival. Attendees who interact with ESF 2019 on social media are expected to follow the code of conduct with regards to their digital engagement.

 Photos and videos will be taken over the course of the festival which will be published on community communications platforms. Please notify a member of ESF team if you would like to be omitted from any visuals captured over the course of the event.

Refund Policy

All refund requests must be submitted via email to [email protected]

Requests for a full refund must be made no later than 10 business days prior to the event. There will be no full refunds for requests made with less than 10 business days’ notice prior to this.

There will be no partial refunds granted.

Exceptions: Participants will receive a full refund with less than 10 days’ notice in the following cases:

·        The Organising committee cancels the tournament

·        Tournament is cancelled due to inclement weather conditions

·        Medical emergency or death in the immediate family of a player (proof required)

No refund of any type will be granted to any team that voluntarily withdraws after tournament begins.

Opting Out

You have the right to ask us not to process your personal data for marketing and promotional purposes and you may opt out of any of our e-mail or SMS contact, even if you have previously indicated your consent to such contact, by following the “Unsubscribe” process described in our emails or by sending an email to [email protected]
